I read the latest development on the Perak assembly sitting on 28th October with great amusement.
It says: "The police today obtained an injunction from the Magistrate’s Court here preventing members of the public from entering within a 50-meter radius of the Perak State Secretariat building."
On what basis was the injunction granted? I wonder if the presiding judge has turned fortune teller. The order states that the court believed that although no applications were made to obtain permits, the gatherings would still be carried out.
The injunction is problematic and should be challenged on the basis that it infringes the democratic right of Perakians to attend the state assembly to follow a proceeding in an orderly manner. The state assembly is a symbol of people's power and democracy.
It is odd that the judiciary is interfering again in the Perak state assembly fiasco but rightly refuses to interfere with the decisions of the parliament.
Puchong MP Gobind Singh Deo remains barred from the Dewan Rakyat after the High Court ruled that legislative proceedings cannot be challenged in court, in a decision which appears to go against an earlier Federal Court ruling.
The decision by the High Court relies on a generally accepted principle of Separation of Powers but contradicts a Federal Court ruling in April which said it was allowed to inquire into legislative proceedings.
If the court can issue an injunction to infringe the democratic rights of the people, can we obtain an injunction against the judiciary for not respecting the spirit of the federal and state constitutions?
This injunction is very odd. It puts the entire judiciary to test for not being able to act consistently and transparently. Its unpredictability calls for the setting up of a Judicial Commission to investigate irregularities of judges and their judgements.
