Cabinet ministers cannot sack or suspend any civil servant who are categorised as “permanent Government officers.”
Deputy Prime Minister Muhyiddin Yassin said he has not seen any record of a minister taking such actions against these officers, who are under the jurisdiction of the Public Services Department.
"There is no law in the administrative regulations and in the Constitution providing for ministers to sack or suspend any permanent civil servant,” he said, adding that this includes the deputy prime minister.
This is probably one of the most disturbing statements which came from the administration. I have a few questions for the DPM. First, who is the PSD answerable to? What is the role of the administration if it does not have any direct control over the ministry and PSD? What is the role of the Education Ministry if it does not have any jurisdiction over the conduct of teachers and administrative staff?
Muhyiddin statement may derail any hope of reforming the civil service which is long seen as ineffective, cumbersome, flabby and bureaucratic. What is the hope of making the ETP, NEM and a host of other plans a success if the civil service is not performing up to the desired level?
Worse, the DPM is suggesting that public institutions such as the police are acting without any instruction or supervision. Did the police act alone to detain a cartoonist or peaceful ISA demonstrators?
It is dangerous to suggest that there is no provision or administrative regulations to suspend or sack errant civil servants.

All the DPM is saying is he wants their votes to become the next P.M.of Malaysia in a round about way that is all. He hasn't the courage nor the audacity to admit that ! And he wants to be the P.M. of Malaysia ? What a bloody sick joke and what will Malaysia be with a P.M. like this, not that there is a lot to choose from.
This DPM is not fit to be one in the first place.He is there because of that 'racist' ex-PM. I see him of no leadership quality.
Malaysia will be doomed if this guy took over leadership of the country.
Muhyiddin,I demand that you resign as Education Minister immediately because you are incompetent and irresponsible! You don't know how to carry your duty as Education minister by the fact that you don't know how to handle an errant civil servant(who is answerable to your ministry) or that you are trying to shirk your responsibility. You are a laughing stock to the world and a shame to our country!
There are procedures and processes in place, that need to be followed in the sacking of any staff, whether civil servants or private sector staff. As I understand it, there are provisions to sack civil servants. However, I believe that it is true that the DPM has no direct authority to do so. The trouble is that, it usually entails the employee breaking the law.
IIRC, the process is something like this. During the process of investigation, the employee will be parked in the PSD. Once the police investigations are complete and a case is brought to court, the employee is put on half-pay suspension. After the guilty verdict is delivered, the employee is then dismissed.
That is why Johore has not made any progress with him as M.B. and above all the current M.B.
of Johore is emulating his style after so many years of his leadership as M.B..
Time for this old man to go or better still go back to the Kampong where he came from and stop wasting everybody's time. He does not know what he is talking and doing and he needs a NEP scholarship to learn how what to speak not to be educated just like all the Ketunan Melayu.
If DPM has no authority how is it that he's the Minister of Education? Being put as the top of a "head" how do we justify his authority???

I doesn't really know what is happening to this beloved country. If we have an Education Minister cum Deputy Prime Minister who doesn't know his level of authority or his job specifications, then rakyat, we are in BIG TROUBLE!
If he cannot handle a simple solution as this, I am sad to say he does not HAVE it to run the country.
He has not only insulted the intelligence of the rakyat, but most importantly he has insulted the rakyat and the Malays with that kind of explaination.
Seriously, I could go on and on but it is really sad that everything is politicalize. What about this country - the state of economy, the state of education to name the main few agendas that needs serious immediate attention.

We as Malaysians have so much disgust for our MORON ministers. No words can really explain the feelings we have deep inside. Are we having cow brain Ministers running the Nation. Well lets look back from where, when and how they became cows.

Khoo, a good analogy is when an employee in a Company commits a crime. The MD says that he has no power to sack him but the matter is referred to the HR Mgr to act.
